An administrative term of Jackson County Superior Court was held June 26 and 28 at the Justice Center with Judge Brad Letts presiding.

Results of the term are listed below, with information obtained from records on file with the Jackson County Clerk of Court office. Defendants pleaded guilty unless indicated otherwise. In addition to dismissals, dispositions included:

Cody Elmer Levi Queen, 23, Allman Road, Sylva, breaking and/or entering, sentence of not less than eight nor more than 19 months suspended for 18 months and placed on supervised probation on condition he pay fine of $100 and costs, make restitution of $1,200, assigned to TASC and DART programs and given 90 days of electronic house arrest; obtain property by false pretense and possess heroin, sentence of not less than eight nor more than 19 months suspended for 18 months on condition he pay fine of $100 and costs; also admitted to a probation violation, probation revoked and sentence of 45 days activated.

Whitney Leigh Brotherton, 32, Thomas Valley Road, Whittier, admitted to four counts of probation violation, on three counts probation extended 12 months, on fourth count probation terminated.

Colby Alexander Dillard, 21, Clockwork Lane, Sylva, common law robbery, sentence of not less than nine nor more than 20 months suspended for 24 months and placed on special supervised probation on condition he serve 120 days active time, pay fine of $200 and costs, given credit for 37 days served, obtain substance abuse assessment, not be on premises of Western Carolina University and have no contact with co-defendant, assigned to electronic house arrest for 90 days; felony conspiracy and two counts larceny of motor vehicle, sentence of not less than five nor more than 15 months suspended for 24 months and placed on supervised probation on condition he pay costs; larceny of motor vehicle and possess methamphetamine, sentence of not less than five nor more than 15 months suspended for 24 months and placed on supervised probation on condition he pay costs and make restitution.

Kimberly C. Juarez, 36, Windchime Lane, Cashiers, admitted to a probation violation, probation revoked and sentence of not less than five nor more than 15 months activated, given credit for 118 days served, substance abuse treatment, psychiatric and/or psychological counseling, work release and DART program recommended.

Mark Loren Miller, 31, Reservoir Ridge Drive, Cullowhee, sell controlled substance within 1,000 feet of a school and maintain vehicle/dwelling/place for controlled substance, sentence of not less than 23 nor more than 40 months, given credit for seven days served, ordered to pay costs, substance abuse treatment, psychiatric and/or psychological counseling, work release and DART program recommended; sell controlled substance within 1,000 feet of a school and maintain vehicle/dwelling/place for controlled substance, sentence of not less than 23 nor more than 40 months suspended for 24 months and placed on supervised probation on condition he pay fine of $100 and costs and obtain substance abuse assessment; sell controlled substance within 1,000 feet of a school, sentence of not less than 23 nor more than 40 months suspended for 24 months and placed on supervised probation on condition he pay fine of $100 and costs; sell controlled substance within 1,000 feet of a school, sentence of not less than 23 nor more than 40 months suspended for 24 months and placed on supervised probation on condition he pay fine of $100 and costs; sell controlled substance within 1,000 feet of a school, sell/deliver marijuana and conspire to sell marijuana, sentence of not less than 23 nor more than 40 months suspended for 24 months and placed on supervised probation on condition he pay fine of $100 and costs.

Troy Ray York, 23, Greens Creek Road, Sylva, attempted trafficking in opium or heroin by possession and felony possession of cocaine, sentence of not less than 15 nor more than 27 months suspended for 18 months and placed on supervised probation on condition he pay fine of $100 and costs, obtain substance abuse assessment and assigned to electronic house arrest for 90 days.

Willie Ralph Brown, 63, Franklin, driving while impaired – level two, sentence of not less than nor more than 12 months suspended for 12 months and placed on special supervised probation on condition he serve seven days active time, pay costs, obtain substance abuse assessment and surrender driver’s license, given credit for seven days served; felony possession of cocaine, ordered to pay costs.

Samantha Lynn Gunter, 28, Lantana Drive, Sylva, admitted to three counts of probation violation, original judgment modified, sentence of 10 days, probation extended one year.

Kraig Allen Lackey, 34, Nicole Arms Road, Sylva, possess Schedule II substance and possess methamphetamine, sentence of not less than 10 nor more than 21 months suspended for 30 months and placed on special supervised probation on condition he serve 120 days active time, pay costs and obtain GED, given credit for 142 days served; possession dimethlamphetamine and possess methamphetamine, sentence of not less than five nor more than 15 months suspended for 30 months and placed on supervised probation.

Benjamin Scott Hartbarger, 22, Fullwood Lane, Sylva, attempted traffic in heroin by delivery and possess heroin, sentence of not less than 15 nor more than 27 months suspended for 30 months and placed on special supervised probation on condition he serve 120 days, given credit for 144 days served, pay costs, screen for DART program, reside with parents, assigned to TASC, given 120 days electronic house arrest; felony possess Schedule I substance, sentence of not less than five nor more than 15 months suspended for 30 months and placed on supervised probation.

Carsen Elizabeth Byrd, 26, Salisbury, possess heroin, sentence of not less than four nor more than 14 months suspended for 14 months and placed on supervised probation on condition she pay costs and continue drug treatment; two additional counts of possess heroin, sentence of not less than four nor more than 14 months suspended for 14 months and placed on supervised probation; conspire to possess Schedule I substance and felony possess Schedule I substance, sentence of not less than four nor more than 14 months suspended for 14 months and placed on supervised probation.

Kayla Michelle Northrup, 33, Fenway Apartments, Tuckasegee, admitted to a probation violation, probation extended 12 months.

Anita Kaye Vestal, 42, U.S. 441 South, Sylva, appeared on a probation violation, probation terminated.

Alfred William Owle Jr., 39, Phoenix Valley Drive, Sylva, possess methamphetamine, placed on supervised probation for 12 months, ordered to pay costs and not be on premises of Sapahaw Trail or Grandview Estates, report for initial evaluation by TASC or Analenisgi.

Patrick Eugene Williams, 35, Casper Drive, Cullowhee, admitted to a probation violation, sentence of 48 hours and probation extended 12 months.
