Two sessions of Jackson County District Court were held last week at the Justice Center.

A session mainly for traffic cases was held Sept. 28, with Judge Kris Earwood presiding. A session for other cases was held Sept. 29 with Judge Charles Neaves presiding.

Results of the sessions are listed below, with information obtained from records on file with the Jackson County Clerk of Court office. Defendants pleaded guilty unless indicated otherwise. In addition to dismissals and infractions, dispositions included:

Sept. 28

Jennifer Louise Kuykendall, 36, Jonquil Drive, Sylva, driving while impaired – level five, sentence of not less than nor more than 60 days suspended for 12 months and placed on supervised probation on condition she pay costs, obtain substance abuse assessment, surrender driver’s license and perform 24 hours community service.

Michael Edward McLaughlin, 40, Connor Road, Sylva, driving while impaired – level two, sentence of not less than nor more than 12 months suspended for 36 months and placed on supervised probation on condition he pay fine of $350 and costs, obtain substance abuse assessment, surrender driver’s license and 13 days in ADAC in lieu of seven days active time.

Kyle Lee Lackey, 37, U.S. 74 East, Sylva, possess stolen goods, sentence of 120 days suspended for 12 months and placed on supervised probation on condition he pay fine of $100 and costs, make restitution and not be on premises of Plaza Pawn.

David Ross Wike, 74, Norcross, Ga., driving while impaired – level five, sentence of not less than nor more than 60 days suspended for 12 months and placed on unsupervised probation on condition he pay fine of $100 and costs, obtain substance abuse assessment, surrender driver’s license and perform 24 hours community service.

Elvin Amaury Santana, 37, Cactus Loop, Sylva, driving while impaired – level four, sentence of not less than nor more than 120 days suspended for 12 months and placed on unsupervised probation on condition he pay fine of $150 and costs, obtain substance abuse assessment, surrender driver’s license and perform 48 hours community service.

Kyle Michael Jones, 28, Arlington, Texas, driving while impaired – level five, sentence of not less than nor more than 60 days suspended for 12 months and placed on supervised probation on condition he pay fine of $100 and costs, obtain substance abuse assessment and surrender driver’s license.

Ivan Emanuel Hernandez, 24, Hendersonville, driving while impaired – level five, sentence of not less than nor more than 60 days suspended for 12 months and placed on unsupervised probation on condition he pay fine of $100 and costs, obtain substance abuse assessment, surrender driver’s license and perform 24 hours community service.

Kanyon Montana Orr, 26, Archway Drive, Cullowhee, failure to stop for school bus, sentence of 45 days suspended for 12 months and placed on unsupervised probation on condition he pay fine of $250 and costs and surrender driver’s license.

Sept. 29

Cynthia Scruggs Owen, 57, Willets Road, Sylva, admitted to violation of court order, all remaining monies owed to become civil judgment.

Paul Thomas Bowman, 34, Candler, injury to personal property, ordered to make restitution.

Mitchell Jenkins, 33, Passmore Lane, Whittier, trapping without weather-resistant tags, fined $50 and costs.

Jose Trinidad Sanchez, 45, Hopi Village, Tuckasegee, driving while impaired – level five, sentence of not less than nor more than 60 days suspended for 12 months and placed on unsupervised probation on condition he pay fine of $100 and costs, obtain substance abuse assessment, surrender driver’s license and perform 24 hours community service.

James Brian Ashe, 54, Little Savannah Road, Sylva, communicating threats, prayer for judgment continued on condition he pay costs.

Kiera Dianne Banegas, 37, Sarah Smoker Loop, Cherokee, possess drug paraphernalia, fined $100 and costs.

Evelyn Stewart Bailey, 49, Almond, admitted to violation of court order, probation terminated, monies owed to become civil judgment.

Michael Randall Coggins, 48, Luker Branch Road, Tuckasegee, admitted to probation violation, probation extended 12 months and transferred to unsupervised, ordered to complete 20 hours of driving while impaired classes.

In a probable cause hearing, Jose Gutierrez Estrada, 29, Atlanta, Ga., was bound over to Superior Court on two counts of trafficking in methamphetamine and one count each of possess stolen goods and possess drug paraphernalia.
