Two sessions of Jackson County District Court were held last week at the Justice Center with Judge Roy Wijewickrama presiding.

A session mainly for traffic cases was held Aug. 9, with a session for other cases Aug. 10.

Results of the sessions are listed below, with information obtained from records on file with the Jackson County Clerk of Court office. Defendants pleaded guilty unless indicated otherwise. In addition to dismissals and infractions, dispositions included:

 

Aug. 9

Abigail Luda Mayer, 20, Bradenton, Fla., driving while impaired – level five, sentence of not less than nor more than 60 days suspended for 12 months and placed on unsupervised probation on condition she pay fine of $100 and costs, obtain substance abuse assessment, surrender driver’s license and perform 24 hours community service.

Eliot Elizabeth Gaglinese-Woody, 28, Black Mountain, driving while impaired – level five, sentence of not less than nor more than 60 days suspended for 12 months and placed on unsupervised probation on condition she pay fine of $100 and costs, obtain substance abuse assessment, surrender driver’s license and perform 24 hours community service.

Farrell Jerome Burnell, 54, Camden, S.C., driving while impaired – level five, sentence of not less than nor more than 60 days suspended for 12 months and placed on unsupervised probation on condition he pay fine of $100 and costs, obtain substance abuse assessment, surrender driver’s license and receive 30 days of outpatient and 90 days of inpatient treatment.

Kathy Williams Wilson, 65, Bluegrass Drive, Sylva, driving while impaired – level one, sentence of not less than nor more than 12 months suspended for 36 months and placed on supervised probation on condition she pay fine of $500 and costs, obtain substance abuse assessment and surrender driver’s license, given credit for 30 days inpatient treatment, ordered to continue 120 days of wearing alcohol monitoring device, 10 remaining days of active time waived.

Dennis James Walk II, 27, Nicol Arms Apartments, Sylva, driving while impaired – level one, sentence of not less than nor more than 12 months suspended for 36 months and placed on special supervised probation on condition he serve 10 days active time, pay fine of $500 and costs, obtain substance abuse assessment, surrender driver’s license and wear alcohol monitoring device for 120 days.

Ashley Elizabeth Bishop, 38, Franklin, driving while impaired – level four, sentence of not less than nor more than 120 days suspended for 18 months and placed on supervised probation on condition she pay fine of $150 and costs, obtain substance abuse assessment, surrender driver’s license and perform 48 hours community service.

Nathaniel Trenton Evans, 21, Hoot Owle Cove Road, Whittier, driving while license revoked and driving after drinking by person under 21, sentence of 45 days suspended for 12 months and placed on supervised probation on condition he pay fine of $100 and costs and surrender driver’s license.

James David Griffin, 58, Elm Street, Sylva, driving while impaired, sentencing continued to Oct. 4.

Joseph Paul Orth, 35, Fort Meade, Fla., driving while impaired, sentencing continued to Oct. 25.

Evan Stacy Williams, 21, Southeast Ridge Road, Cashiers, driving while impaired, sentencing continued to Nov. 1.

John Kyle Jordan, 44, Waynesville, waived preliminary hearing and was bound over to Superior Court on the following charges: maintain vehicle/dwelling/place for controlled substance, possess drug paraphernalia, traffic in methamphetamine, conspire to traffic methamphetamine, posses with intent to manufacture/sell/distribute methamphetamine.

In a probable cause hearing, James John Welch, 56, Canton, was bound over to Superior Court on the following charges: maintain vehicle/dwelling/place for controlled substance, possess drug paraphernalia, traffic in methamphetamine, conspire to traffic methamphetamine, posses with intent to manufacture/sell/distribute methamphetamine.

In a probable cause hearing, Brandon Lee Nalley, 46, Hendersonville, was bound over to Superior Court  on the following charges: conspire to traffic methamphetamine, possess marijuana paraphernalia, possess marijuana, possess methamphetamine, possess drug paraphernalia.

Travis Jerome Stafflebach, 40, Big Burn Circle, Sylva, waived preliminary hearing on the following charges and was bound over to Superior Court: larceny (eight counts), identity theft, obtain property by false pretense, break/enter motor vehicle (nine counts), injury to personal property (seven counts).

 

Aug. 10

Ashley Elizabeth Hooper, 33, Walton Drive, Sylva, possess drug paraphernalia, sentence of 45 days suspended for 12 months and placed on unsupervised probation on condition she pay fine of $100 and costs.

Sean S. Cahill, 44, Phoenix, Ariz., drunk and disruptive, fined $75 and costs.

Stevie Austin Tucker, 46, Bryson City, open container of alcoholic beverage in passenger area of motor vehicle, sentence of one day, given credit for one day served.

Joshua Burr, 40, Franklin, breaking or entering, sentence of 120 days to run concurrently with any other sentence being served.

Joshua Clifford Marks, 42, Nutmeg Lane, Sylva, domestic violence protective order violation, sentence of 75 days suspended for 12 months and placed on unsupervised probation on condition he pay fine of $75 and costs and have no contact with victim.

Richard Calvin Teesatuskie, 34, Fisher Branch Road, Cherokee, possess drug paraphernalia, placed on unsupervised probation for six months on condition he pay fine of $75 and costs and obtain substance abuse assessment.

Cearra Guth-Greer, 25, Otto, possess drug paraphernalia, placed on unsupervised probation for six months, ordered to pay fine of $100 and costs and obtain substance abuse assessment.

Jessica Aubrey Johnson, 23, Franklin, possess drug paraphernalia, placed on unsupervised probation for three months and ordered to pay fine of $100 and costs.

Benjamin R. Powers, 33, Tampa, Fla., operate boat in reckless manner, fined $50 and costs.

Anna Marie Stephens, 36, Winterberry Drive, Cullowhee, possess drug paraphernalia, sentence of 45 days suspended for 12 months and placed on unsupervised probation on condition she pay fine of $100 and costs, follow recommendations and enroll in and complete parenting course.

Sandy Tyson, 48, Gatlinburg, Tenn., disorderly conduct in public building, prayer for judgment continued from term to term for 12 months on condition she pay costs and not be on premises of Harrah’s Cherokee Casino.

Shawn Littlebull Standingdeer, 35, Capuchin Drive, Sylva, waived preliminary hearing and was bound over to Superior Court on two counts of sex act by substitute parent/custodian and two counts statutory rape of child under 15.

Tahzyah Kebian Whitson, 18, Asheville, waived preliminary hearing and was bound over to Superior Court on the following charges: traffic in methamphetamine (two counts), maintain vehicle/dwelling/place for controlled substance, possess drug paraphernalia, conspire to traffic methamphetamine and possess with intent to manufacture/sell/deliver methamphetamine.
