Three sessions of Jackson County District Court were held recently at the Justice Center.

Judge Donna Forga presided at a session mainly for traffic cases Sept. 9. Judge Kris Earwood and Judge Rick Walker presided at sessions for other cases on Sept. 4 and Sept. 10, respectively.

Results of the sessions are listed below, with information obtained from records on file with the Jackson County Clerk of Court office. Defendants pleaded guilty unless indicated otherwise. In addition to dismissals and infractions, dispositions included:

Sept. 4

Jerry Trevan Smith, 23, Beck Branch Road, Whittier, was found guilty of assault on a female, prayer for judgment continued from term to term for 12 months on condition he pay costs.

Bobby Burnley, 54, Derby Road, Cullowhee, admitted to a probation violation, probation extended for 18 months.

Melissa Madeline Cauble Berretta, 44, Canton, larceny, sentence of 30 days; also admitted to a probation violation, original judgment modified, sentence of 15 days, sentences to run concurrently.

Carolyn Elizabeth Keck Loftis, 29, Camp Creek Road, Whittier, admitted to a probation violation, probation revoked and sentence of 45 days activated, given credit for 15 days served.

Brian Elliott Teesateskie, 43, Robbinsville, larceny, sentence of 73 days, given credit for 73 days served, ordered to pay costs.

Amber Danielle Hudson, 36, East Fork Road, Sylva, communicating threats and cyberstalking, sentence of 120 days suspended for 12 months and placed on unsupervised probation on condition she pay costs and have no contact with victim.

Jimmy Wayne Edwards, 26, Begonia Lane, Sylva, resisting public officer, prayer for judgment continued.

Vella Mae Rhinehart, 44, Lance Road, Cashiers, pleaded no contest to possess drug paraphernalia, placed on unsupervised probation for 12 months, ordered to pay fine of $50 and costs and obtain substance abuse assessment.

Terrell Michael Rogers, 31, Old Bryson Branch Road, Whittier, possess marijuana, sentence of 120 days suspended for 18 months and placed on supervised probation on condition he pay fine of $100 and costs and obtain substance abuse assessment.

Travis Jamey Sizemore, 39, Haywood Road, Sylva, assault on a female, sentence of 150 days suspended for 18 months and placed on supervised probation on condition he pay fine of $100 and costs, have no contact with victim and obtain domestic violence assessment.

Charlotte Rhea Fonseca, 28, Bayberry Cove Road, Sylva, driving while impaired and possess marijuana, continued to Oct. 7 for sentencing.

Brandi Nicole Moore, 25, Fisher Creek Road, Sylva, admitted to two counts of probation violation, on each count original judgment modified, probation extended 12 months and sentence of 30 days, defendant appealed.

Sept. 9

Jackie Brian Stewart, 38, Alaska Drive, Cashiers, driving while impaired, continued to Oct. 7 for sentencing.

Karen Lynne Ogle, 53, Shoal Creek Road, Whittier, no operator’s license, fined $50 and costs.

Cynthia Brown Eller, 57, Junaluska Drive, Whittier, driving while impaired – level five, sentence of not less than nor more than 60 days suspended for 12 months and placed on unsupervised probation on condition she pay fine of $100 and costs, obtain substance abuse assessment, surrender driver’s license and perform 24 hours community service, given credit for 22 days served.

Kaitlyn Reyor, 24, Sylva, no operator’s license, fined $50 and costs.

Jackie Kevin Shelton, 45, Waynesville, no operator’s license, fined $50 and costs.

Kathy Williams Wilson, 63, Bluegrass Drive, Sylva, was found guilty of driving while impaired – level two, sentence of not less than nor more than 12 months suspended for 36 months and placed on supervised probation on condition she pay fine of $350 and costs, obtain substance abuse assessment, surrender driver’s license, perform 90 hours community service and abstain from alcohol consumption for 90 days; also found guilty of speeding 76 mph in a 55 mph zone, prayer for judgment continued on condition she pay costs.

Jasmine Raedean Lambert, 31, Bill Lambert Road, Cherokee, driving while impaired – level five, sentence of not less than nor more than 60 days suspended for 12 months and placed on unsupervised probation on condition she pay fine of $100 and costs, obtain substance abuse assessment, surrender driver’s license and perform 24 hours community service.

Cecil Virgil Jones Jr., 52, Waynesville, no operator’s license, fined $50 and costs.

Leander Jarrell, 27, Buckden Park Drive, Sylva, no operator’s license, fined $50 and costs.

Thomas Frank Scott, 39, Dills Branch Road, Sylva, no operator’s license, fined $50 and costs.

Wesley Jordan Wildcatt, 19, Wrights Creek Road, Cherokee, no operator’s license, fined $50 and costs.

Timothy John Coggins Jr., 32, Vintage Lane, Sylva, littering beer/wine container, fined $25 and costs.

Jose Manuel Cortes Batalla, 21, Swannanoa, possess marijuana, placed on unsupervised probation for 12 months, fined $50 and ordered to complete Drug Education School; resisting public officer, obstructing an officer and speeding 75 mph in a 35 mph zone, sentence of 30 days suspended for 12 months and placed on unsupervised probation on condition he pay fine of $130 and costs and perform 24 hours community service; driving while impaired, continued to Oct. 7 for sentencing.

Sept. 10

Jeffery Scott Petit, 52, Wild Ridge, Cashiers, admitted to a probation violation, original judgment modified, sentence of seven days.

Cynthia Scruggs Owen, 56, Willets Road, Sylva, larceny, sentence of 45 days suspended for 12 months and placed on unsupervised probation on condition she pay fine of $100 and costs, make restitution and not be on premises of Food Lion.

Tonya Lynn Maney, 30, A Model Drive, Whittier, possess stolen goods, sentence of 18 days, given credit for 18 days served.

Dustin Wade Walker, 23, Safe Haven Road, Sylva, domestic violence protective order violation, sentence of 75 days suspended for 18 months and placed on special unsupervised probation on condition he serve 16 days active time, pay fine of $300 and costs and have no contact with and not be on premises of victim, given credit for 16 days served.

Tabetha Brooke McGaha, 38, Etowah, larceny, sentence of 22 days, given credit for 22 days served.

Robert David Caron, 61, Asheville, drunk and disruptive and littering, sentence of 19 days to run concurrently with sentence being served.

Daniel Brian Ledford, 26, Waynesville, carrying concealed weapon and driving while license revoked, sentence of 14 days, given credit for 14 days served.

Robert David Caron, 61, Waynesville, second-degree trespass, drunk and disruptive and disorderly conduct, sentence of 29 days, given credit for 29 days served; littering, disorderly conduct and two counts drunk and disruptive, sentence of 20 days.
