Two sessions of Jackson County District Court were held last week at the Justice Center with Judge Donna Forga presiding.

A session mainly for traffic cases was held May 28, with a session for other cases May 29.

Results of the sessions are listed below, with information obtained from records on file with the Jackson County Clerk of Court office. Defendants pleaded guilty unless indicated otherwise. In addition to dismissals and infractions, dispositions included:

May 28

Joshua Brier Nations, 21, Old Cullowhee Road, Cullowhee, driving after drinking by person under 21, sentence of 15 days suspended for 12 months and placed on unsupervised probation on condition he pay fine of $50 and costs and obtain substance abuse assessment; simple assault, prayer for judgment continued on condition he pay costs.

John Paul Bartko, 46, Helen Zachary Road, Cullowhee, driving while impaired – level five, sentence of not less than nor more than 60 days suspended for 12 months and placed on unsupervised probation on condition he pay fine of $100 and costs, obtain substance abuse assessment, surrender driver’s license and perform 24 hours community service.

Joshua Henline, 31, Spruce Pine, larceny, sentence of 45 days suspended for 12 months and placed on unsupervised probation on condition he pay costs, make restitution and not be on premises of victim.

Jacqueline Quinn Ripple, 27, Searcy Mountain Road, Cullowhee, driving while impaired – level four, sentence of not less than nor more than 120 days suspended for 12 months and placed on unsupervised probation on condition she pay fine of $150 and costs, obtain substance abuse assessment, surrender driver’s license and perform 48 hours community service.

Matthew G. Leberte, 18, Cumming, Ga., driving after drinking by person under 21, sentence of 15 days suspended for 12 months and placed on unsupervised probation on condition he pay fine of $100 and costs, surrender driver’s license and obtain substance abuse assessment.

Brianna Linn Bowman, 22, Candler Nation Road, Cherokee, driving while impaired – level five, sentence of not less than nor more than 60 days suspended for 12 months and placed on unsupervised probation on condition she pay fine of $100 and costs, obtain substance abuse assessment, surrender driver’s license and perform 24 hours community service.

Patrick Alan Gilcher, 35, Franklin, driving while license revoked, sentence of 45 days suspended for 24 months and placed on unsupervised probation on condition he pay fine of $100 and costs and perform 48 hours community service.

Justin Carlock Hornsby, 31, Grape Cove Road, Sylva, driving while impaired – level five, sentence of not less than nor more than 60 days suspended for 12 months and placed on unsupervised probation on condition he pay fine of $100 and costs, obtain substance abuse assessment, surrender driver’s license and perform 24 hours community service.

Michaela Maria Woodard, 24, Stoneville, driving while impaired – level five, sentence of not less than nor more than 60 days suspended for 12 months and placed on unsupervised probation on condition he pay fine of $100 and costs, obtain substance abuse assessment and surrender driver’s license, given credit for 70 hours community service.

Jamie Wesley Williams, 32, Sleeper Branch Road, Whittier, was found guilty of driving while impaired – level two, sentence of not less than nor more than 12 months suspended for 36 months and placed on special supervised probation on condition he serve seven days active time, pay fine of $350 and costs, obtain substance abuse assessment, surrender driver’s license and perform 90 hours community service.

Emily Anne Chandler, 20, Franklin, driving after drinking by person under 21, sentencing continued to June 10.

Sterling Frank Nottingham, 26, Holly Road, Sapphire, driving while impaired, sentencing continued to July 29.

Paul Glen Webb III, 47, Asheville, driving while impaired, sentencing continued to July 29.

Jessica Gail Conway, 33, Columbus George Road, Cherokee, defrauding drug/alcohol screen tests, sentence of 15 days suspended for 12 months and placed on supervised probation on condition she pay costs and serve one day active time; also admitted to probation violation, probation revoked and sentence of one day activated, given credit for one day served.

Jess H. Cagle, 46, Winesap Drive, Sylva, admitted to a probation violation, probation terminated.

Jonathan Sam Brady, 37, Dark Ridge Road, Sylva, admitted to a probation violation, probation revoked and sentence of 60 days activated, given credit for 60 days served.

Johnson Lloyd Sequoyah, 37, Bryson City, admitted to a probation violation, original judgment modified sentence of three days.

Shena Dale Standingdeer, 37, Qualla Town Road and Fields Road, Whittier, larceny, sentence of 120 days, given credit for 21 days served; admitted to a probation violation, probation revoked and sentence of not less than nor more than 60 days activated.

Aaron Dukes, 40, Duncan, S.C., two counts common law forgery, sentence of 30 days suspended for 24 months and placed on unsupervised probation on condition he pay fine of $100 and costs and make restitution of $1,400.

Kyle Lee Lackey, 36, Milford Lane, Sylva, possess stolen goods and larceny, sentence of 25 days suspended for 12 months and placed on unsupervised probation on condition he pay fine of $25 and costs, make restitution and not be on premises of Plaza Pawn.

Manuel Martinez, 25, Belle Glade, Fla., possess marijuana paraphernalia, fined $50 and costs.

Michaela Rebecca Willard, 25, Franklin, driving while impaired – level five, sentence of not less than nor more than 60 days suspended for 12 months and placed on unsupervised probation on condition she pay fine of $100 and costs, obtain substance abuse assessment, surrender driver’s license and perform 24 hours community service.

Markus Todd Altizer, 45, Bristol, Va., false fire alarm, sentence of five days suspended for 12 months and placed on unsupervised probation on condition he pay fine of $25 and costs and not be on premises of Harrah’s Cherokee Casino.

Three misdemeanor cases were heard June 5 in a session mainly for juvenile cases presided over by Judge Roy Wijewickrama:

Heather Manogue, 28, Leelanau Drive, Sylva, school attendance law violation, prayer for judgment continued for 12 months on condition child attends school.

Heather Desmond, 30, Bryson City, school attendance law violation, prayer for judgment continued for 12 months on condition she pay costs and child attends school.
