Two sessions of Jackson County District Court were held last week at the Justice Center with Judge Roy Wijewickrama presiding.

A session mainly for traffic cases was held Oct. 4, with a session for other cases Oct. 5.

Results of the sessions are listed below, with information obtained from records on file with the Jackson County Clerk of Court office. Defendants pleaded guilty unless indicated otherwise. In addition to dismissals and infractions, dispositions included:

 

Oct. 4

Michael John Bartolotta, 44, Franklin, driving while impaired – level four, sentence of not less than nor more than 120 days suspended for 18 months and placed on supervised probation on condition he pay fine of $150 and costs, obtain substance abuse assessment, surrender driver’s license and perform 48 hours community service.

Catrina Ann Brown, 39, Edgewater Road, Cullowhee, driving while impaired – level two, sentence of not less than nor more than 12 months suspended for 24 months and placed on supervised probation on condition she pay fine of $500 and costs, obtain substance abuse assessment and surrender driver’s license, assigned to continuous alcohol monitoring for 90 days; also admitted to a probation violation, sentence of 20 days, probation extended six months.

Devan Patrick Libby, 22, Charlotte, driving while impaired – level four, sentence of not less than nor more than 120 days suspended for 12 months and placed on unsupervised probation on condition he pay fine of $150 and costs, obtain substance abuse assessment, surrender driver’s license and perform 48 hours community service.

Daniel Brent Posey Jr., 28, Franklin, driving while impaired, continued until Oct. 25 for sentencing.

Preston Richard Ramsey, 26, U.S. 441, Whittier, driving while impaired, sentencing continued to Oct. 25.

Sebastian Nogueravisbal, 26, Arrowmont Trail, Cullowhee, driving while impaired – level five, sentence of not less than nor more than 60 days suspended for 12 months and placed on unsupervised probation on condition he pay fine of $100 and costs, obtain substance abuse assessment, surrender driver’s license and perform 24 hours community service.

Quenten Carrie Riggs, 25, Pyramid Place, Sylva, driving while impaired – level two, sentence of not less than nor more than six months; assault on a female, sentence of 50 days, ordered to have no contact with victim, sentences to run concurrently.

Zachery Wayne Smith, 32, Kingston, Tenn., second–degree trespass, prayer for judgment continued for one year on condition he pay costs and not be on premises of Harrah’s Cherokee Casino.

 

Oct. 5

Marcus Thad Deville, 26, Franklin, second–degree trespass, sentence of two days, given credit for two days served.

Johnnie Ray Lossiah, 30, Lossiah Drive, Cherokee, possess drug paraphernalia, sentence of 12 days, given credit for 12 days served.

Alisha Kaye Toineeta, 29, Kallups Cold Mountain Road, Cherokee, possess drug paraphernalia, sentence of 13 days, given credit for 13 days served.

Loretta Lynn Rosario, 52, Canada Road, Tuckasegee, possess drug paraphernalia, ordered to pay fine of $50 and costs and obtain substance abuse assessment, given credit for 19 days served.

Justin Todd Bryson, 31, Cedar Valley Road, Tuckasegee, unlawfully take wild turkey, fined $250 and costs and surrender hunting license for two years.

Daryl Lynn Bryson, 54, Mill Creek Road, Cullowhee, possess drug paraphernalia, sentence of 60 days suspended for 12 months and placed on unsupervised probation, prayer for judgment continued.

Jordyn Sloan Morris, 23, John T Drive, Whittier, driving while impaired – level five, sentence of not less than nor more than 60 days suspended for 12 months and placed on unsupervised probation on condition she pay fine of $100 and costs, obtain substance abuse assessment, not operate motor vehicle and perform 24 hours community service.

Natasha Belle Kirkland, 33, A Model Drive, Whittier, possess drug paraphernalia, sentence of 60 days, given credit for seven days served, prayer for judgment continued.

Cecelia Belle Bigwitch, 30, Blue Wing Road, Cherokee, possess drug paraphernalia, sentence of 60 days suspended for 12 months and placed on unsupervised probation on condition she pay fine of $100 and costs, surrender driver’s license and perform 24 hours community service.

Michael Carl Hadley, 30, Lillington, admitted to failure to complete community service, sentence of one day, given credit for one day served.

Jordan Christopher Becker, 31, Canton, communicating threats, sentence of 45 days suspended for 12 months and placed on supervised probation on condition he pay fine of $50 and costs, make restitution and have no contact with victims.

Mark Allen Winstead, 35, Old Soco Road, Cherokee, possess Schedule II substance, sentence of 45 days suspended for 18 months and placed on supervised probation on condition he pay fine of $100 and costs and obtain substance abuse assessment.

Tinola David Wildcat, 44, Acree Drive, Cherokee, possess drug paraphernalia, sentence of 45 days suspended for 18 months and placed on supervised probation on condition he pay fine of $100 and costs and obtain substance abuse assessment.

Niles Landon Reinhardt, 28, Asheville, simple assault, sentence of 45 days suspended for 18 months and placed on supervised probation on condition he pay fine of $100 and costs, have no contact with victims and complete domestic violence intervention program; cyberstalking, sentence of 45 days suspended for 18 months and placed on supervised probation on condition he pay fine of $75 and costs and perform 48 hours community service.

Travis Wayne Fisher, 35, Norman Drive, Sylva, waived preliminary hearing and was bound over to Superior Court on charges of intimidating a witness and assault on a female.
