Three sessions of Jackson County District Court were held last week at the Justice Center.

Judge Donna Forga presided at a session mainly for traffic cases Oct. 19 and a session for other cases Oct. 20. Judge Warren Hughes presided at a session for trials Oct. 21.

Results of the sessions are listed below, with information obtained from records on file with the Jackson County Clerk of Court office. Defendants pleaded guilty unless indicated otherwise. In addition to dismissals and infractions, dispositions included:

Oct. 19

Joseph Edward Massie, 41, Waynesville, driving while impaired – level five, sentence of not less than nor more than 60 days suspended for 12 months and placed on unsupervised probation on condition he pay fine of $100 and costs, obtain substance abuse assessment, surrender driver’s license and perform 24 hours community service.

Buford William Smith, 48, Old Mission Road, Cherokee, driving while impaired – level five, sentence of not less than nor more than 60 days suspended for 12 months and placed on unsupervised probation on condition he pay fine of $100 and costs, obtain substance abuse assessment, surrender driver’s license and perform 24 hours community service.

Farrell Edward Oocumma, 34, Bourbon Street, Whittier, driving while impaired – level five, sentence of not less than nor more than 60 days suspended for 12 months and placed on unsupervised probation on condition he pay fine of $100 and costs, obtain substance abuse assessment, surrender driver’s license and perform 24 hours community service.

Mary Kathleen Morris, 55, Clyde, driving while impaired – level one, sentence of not less than nor more than six years suspended for 36 months and placed on supervised probation on condition she pay fine of $500 and costs, obtain substance abuse assessment, surrender driver’s license, perform 120 hours community service and abstain from alcohol consumption for 120 days, given  credit for 10 days of in-patient treatment in lieu of active time.

Richard Charles Mastromatteo Jr., 26, Clayton, driving while impaired – level five, sentence of not less than nor more than 60 days suspended for 12 months and placed on unsupervised probation on condition he pay fine of $100 and costs, obtain substance abuse assessment, surrender driver’s license and perform 24 hours community service.

Aaron Joseph Livingston, 50, Trinket Lane, Whittier, and Homosassa, Fla., driving while impaired – level four, sentence of not less than nor more than 120 days suspended for 24 months and placed on unsupervised probation on condition he pay fine of $250 and costs, obtain substance abuse assessment, surrender driver’s license and perform 36 hours community service; driving while impaired – level two, sentence of not less than nor more than 12 months suspended for 36 months and placed on special supervised probation on condition he serve 14 days active time, pay fine of $500 and costs, obtain substance abuse assessment, surrender driver’s license and perform 96 hours community service.

Christian Chandler Bonin, 20, Fargo Lane, Sylva, driving while impaired – level five, sentence of not less than nor more than 60 days suspended for 12 months and placed on supervised probation on condition he pay fine of $25 and costs, obtain substance abuse assessment, surrender driver’s license and perform 24 hours community service; consuming alcoholic beverage by person underage, sentence of 10 days suspended for 12 months and placed on supervised probation.

Oct. 20

Jonathan Michael Williams, 24, Buff Creek Road, Sylva, possess drug paraphernalia, placed on supervised probation for 12 months, fined $50 and costs, ordered to perform 24 hours community service and complete drug education class.

David Frederick Greene, 55, Bryson City, breaking or entering, sentence of 45 days suspended for 24 months and placed on unsupervised probation on condition he pay fine of $100 and costs and not be on premises of Southwestern Community College.

Jesse Odell Emery, 53, Mark Bigmeat Road, Cherokee, larceny by trick, sentence of 45 days suspended for 24 months and placed on unsupervised probation on condition he pay fine of $50 and costs and make restitution.

James Russell Wilson, 52, U.S. 74 West, Whittier, common law forgery and common law uttering, sentence of 30 days suspended for 12 months and placed on supervised probation on condition he pay costs, make restitution and have no contact with victim, given credit for seven days served.

David Thomas Harris, 49, Ashley Cagle Road, Sylva, admitted to a probation violation, ordered to complete DWI treatment.

Crystal Beth Arkansas, 38, Ruth Sneed Road, Cherokee, resisting public officer, sentence of 30 days suspended for 24 months and placed on unsupervised probation, given credit for 23 days served, ordered to not be on premises of Catamount Travel Center.

Clarissa Smith, 31, Franklin, admitted to failure to complete community service, sentence of 15 days, given credit for 15 days served.

Tammy Sutton Swayngim, 51, Floral Drive, Sylva, admitted to a probation violation, sentence of four days.

Christopher Russell Queen, 32, Canada Road, Tuckasegee, admitted to a probation violation, probation to be terminated after monies owed paid.

Joseph D. Jacobs Jr., 28, Gospel Drive, Sylva, admitted to a probation violation, probation terminated unsuccessfully.

Jessica Myraah McCoy, 26, Union Hill Road, Cherokee, admitted to two counts of probation violation, on each count probation terminated and monies owed to become civil judgment.

Marcos Edmund Mundo, 39, Weaverville, resisting public officer, sentence of 45 days suspended for 24 months and placed on unsupervised probation on condition he pay fine of $100 and costs, given credit for six days served.

Dustin H. Tramper, 31, Old Soco Road, Cherokee, admitted to a probation violation, ordered to continue treatment with Analenisgi, probation terminated unsuccessfully.

In a probable cause hearing, Marshall Alan Pye, 30 Candler, was bound over to Superior Court on charges of flee/elude arrest with motor vehicle and assault with deadly weapon on government official, charges of expired operator’s license, reckless driving, drive left of center and unsafe passing were transferred to Superior Court.

Oct. 21

Steven Jones, 63, Diamond Ridge, Whittier, was found guilty of assault and battery, prayer for judgment continued on condition he pay costs.

Rodney Coggins, 54, Diamond Ridge, Whittier, was found guilty of assault and battery and second-degree trespass, prayer for judgment continued on condition he pay costs.
