Two sessions of Jackson County District Court were held last week at the Justice Center with Judge Roy Wijewickrama presiding.

A session mainly for traffic cases was held April 22, with a session for other cases April 23.

Results of the sessions are listed below, with information obtained from records on file with the Jackson County Clerk of Court office. Defendants pleaded guilty unless indicated otherwise. In addition to dismissals and infractions, dispositions included:

April 22

Austin Trent Davis, 23, Royal Fern Drive, Sylva, driving while impaired – level four, sentence of not less than nor more than 120 days suspended for 12 months and placed on unsupervised probation on condition he pay fine of $150 and costs, obtain substance abuse assessment, surrender driver’s license and perform 48 hours community service.

Janet Anne Downs, 53, Canada Road, Tuckasegee, driving while impaired – level five, sentence of not less than nor more than 60 days suspended for 12 months and placed on unsupervised probation on condition she pay fine of $100 and costs, obtain substance abuse assessment, surrender driver’s license and perform 24 hours community service.

Kevin Charles Baker, 33, Murphy, driving while impaired – level five, sentence of not less than nor more than 60 days suspended for 12 months and placed on unsupervised probation on condition he pay fine of $100 and costs, obtain substance abuse assessment, surrender driver’s license and perform 24 hours community service.

Nathaniel John Bejblik Murphy, 26, Bear Ridge Road, Tuckasegee, driving while impaired – level five, sentence of not less than nor more than 60 days suspended for 12 months and placed on unsupervised probation on condition he pay fine of $100 and costs, obtain substance abuse assessment, surrender driver’s license and perform 24 hours community service.

Manuel S. Hernandez, 32, Violet Drive, Sylva, driving while impaired – level five, sentence of not less than nor more than 60 days suspended for 12 months and placed on unsupervised probation on condition he pay fine of $100 and costs, obtain substance abuse assessment, surrender driver’s license and perform 24 hours community service.

Drake Hayden Nicholas Miller, 24, Clemmons, driving while impaired – level five, sentence of not less than nor more than 60 days suspended for 12 months and placed on unsupervised probation on condition he pay fine of $100 and costs, obtain substance abuse assessment, surrender driver’s license and perform 24 hours community service.

Jonathan Edward Baxley, 62, Topeka Drive, Sylva, failure to stop for school bus, sentence of 10 days suspended for 12 months and placed on unsupervised probation on condition he pay fine of $500 and costs.

James Tyler Griffin, 27, Indian Mound Road, Cullowhee, no operator’s license, fined $50 and costs.

James Clayton Sherrill, 48, Old Gap Road, Cherokee, no operator’s license, fined $50 and costs.

Richard Travis Akers, 37, Walter Ashe Road, Sylva, no operator’s license, fined $50 and costs.

Megan Ashlee Mehaffey, 23, Waynesville, driving while impaired – level five, sentence of not less than nor more than 60 days suspended for 12 months and placed on unsupervised probation on condition she pay fine of $100 and costs, obtain substance abuse assessment, surrender driver’s license and perform 24 hours community service.

Shelly Lee Pabis, 26, Sunrise Park, Sylva, driving while impaired – level one, sentence of not less than nor more than 12 months suspended for 24 months and placed on special supervised probation on condition she serve 30 days active time, pay fine of $500 and costs, obtain substance abuse assessment and surrender driver’s license, active time to include 28 days of inpatient treatment.

Briana Linn Bowman, 22, Candler Nation Road, Cherokee, driving while impaired, sentencing continued to May 28.

April 23

Tori Shey Gunter, 31, Wolfetown Road, Cherokee, admitted to two counts of probation violation, on each count probation revoked and sentence of 45 days activated, sentences to run concurrently.

Devin Charles Grady, 23, Bryson City, two counts larceny by trick, sentence of 45 days suspended for 18 months and placed on supervised probation on condition he pay fine of $75 and costs, make restitution and not be on premises of Tribal Pawn or Plaza Pawn.

Joseph Brandon Hall, 25, Ferguson Road, Sylva, possess drug paraphernalia, sentence of 45 days suspended for 18 months and placed on supervised probation on condition he pay fine of $100 and costs.

Jesse Lonnie Harkins, 29, Mill Creek Road, Cullowhee, defraud drug/alcohol screening test, sentence of 120 days, fined $50 and costs; admitted to a probation violation, probation revoked and sentence of 120 days activated, given credit for 14 days served, sentences to run concurrently.

Robert Earl Hutchinson, 54, Bob Seay Road, Cherokee, admitted to a probation violation, probation terminated.

Henry Whiperwil Mahsetky, 37, Big Cove Road, Cherokee, larceny, resisting public officer and attempt break/enter motor vehicle, sentence of 45 days.

Jessica Myraah McCoy, 25, Furman Smith Road, Cherokee, admitted to two counts of probation violation, on each count probation modified and sentence of 20 days, given credit for 18 days served, sentences to run concurrently.

Teddy Lee Wilson, 46, Beck Branch Road, Whittier, admitted to a probation violation, original judgment modified and sentence of 10 days.

Cade Alton Lewis Marsh, 19, Murphy, possess drug paraphernalia and possess marijuana paraphernalia, placed on unsupervised probation for six months, ordered to pay fine of $75 and costs, perform 24 hours community service and report for initial evaluation by assessment agency.

Scott Nelson, 35, Union Hill Road, Whittier, admitted to a probation violation, original judgment modified, assigned to electronic monitoring for 120 days with curfew of 7 p.m.-7 a.m.

Andy Harold Fisher, 39, Garnet Road, Sylva, admitted to a probation violation, original judgment modified, probation extended 12 months.

Carson Grey Murphy, 20, Nicol Arms Road, Sylva, possess marijuana paraphernalia, placed on unsupervised probation for six months, ordered to pay fine of $50 and costs and report for initial evaluation by assessment agency.

Phillip Jordan Andrews, 22, Asheville, possess marijuana and possess marijuana paraphernalia, sentence of 30 days suspended for 12 months and placed on unsupervised probation on condition he pay fine of $100 and costs.

Jonathan Matthew Malpass, 43, Bryson City, resisting public officer, sentence of 10 days suspended for 12 months and placed on unsupervised probation on condition he pay fine of $75 and costs.

Jose Luis Reyes, 16, Sylva, assault and battery, prayer for judgment continued for one year and ordered to have no contact with victim.

Brook Tiffany Clonch, 26, Fiddlers Green, Balsam, defraud drug/alcohol screen test, sentence of 40 days, given credit for 40 days served.

J.C. Hershel Payne, 62, Sylva, cruelty to animals and abandonment of an animal, sentence of 45 days suspended for 12 months and placed on unsupervised probation on condition he pay fine of $100 and costs and make restitution.
