Two sessions of Jackson County District Court were held last week at the Justice Center with Judge Donna Forga presiding.

A session mainly for traffic cases was held Feb. 3, with a session for other cases Feb. 4.

Results of the sessions are listed below, with information obtained from records on file with the Jackson County Clerk of Court office. Defendants pleaded guilty unless indicated otherwise. In addition to dismissals and infractions, dispositions included:

Feb. 3

Otono Milan Rodriguez, 28, Grassy Branch Road, Cherokee, driving while license revoked, fined $50 and costs.

Cameron Miller Webb, 29, Monteith Gap Road, Cullowhee, driving while impaired – level two, sentence of not less than nor more than 12 months suspended for 36 months and placed on supervised probation on condition he pay fine of $350 and costs, obtain substance abuse assessment, perform 90 hours community service and abstain from alcohol consumption for 90 days.

Trent Lee Munford, 19, Ahoskie, driving while impaired – level five, sentence of not less than nor more than 60 days suspended for 12 months and placed on unsupervised probation on condition he pay fine of $100 and costs, obtain substance abuse assessment, surrender driver’s license and perform 24 hours community service.

Zachary Roy Barker, 20, Wilmington, driving after drinking by person under 21, sentence of 15 days suspended for 24 months and placed on unsupervised probation on condition he pay fine of $50 and costs, surrender driver’s license, perform 24 hours community service and obtain substance abuse assessment.

Joseph Aaron Rhinehart, 18, Virginia Lane, Cullowhee, reckless driving, prayer for judgment continued on condition he pay costs.

Feb. 4

Allan Dewayne Rathbone, 38, Mill Spring, assault on female, sentence of 150 days suspended for 12 months and placed on supervised probation on condition he pay fine of $100 and costs, obtain domestic violence assessment and have no contact with victim, given credit for 130 days served.

Richard Burgess Kinsey, 32, Pine  Creek Road, Cullowhee, breaking or entering, larceny, possess stolen goods and resist public officer, sentence of 120 days suspended for 24 months and placed on supervised probation on condition he pay fine of $100 and costs and have no contact with and not be on premises of victim.

Ariel Marie Fisher, 28, Molasses Drive, Sylva, larceny and first-degree trespass, sentence of 45 days suspended for 24 months and placed on supervised probation on condition she pay fine of $50 and costs, make restitution of $1,861.54 and not be on premises of Walmart; unauthorized use of motor vehicle, sentence of 45 days suspended for 24 months on condition she have no contact with victim and complete TASC assessment.

Michael James George, 45, Columbus George Road, Whittier, was found in violation of probation, probation revoked and sentence of 75 days activated, given credit for 16 days served.

Devin Dacoda Collins, 27, Bryson City, possess drug paraphernalia, sentence of 120 days suspended for 24 months and placed on supervised probation on condition he pay fine of $100 and costs and complete TASC assessment; two counts financial card fraud, sentence of 60 days suspended for 24 months and placed on supervised probation on condition he pay fine of $100, make restitution of $900 and have no contact with victim, given credit for 28 days served.

Anthony Mitchell Hurst, 36, Boyd Catolster Road, Cherokee, driving while license revoked, sentence of 10 days, given credit for 10 days served.

Daniel Aaron Peterson, 20, Murphy, driving while impaired – level five, sentence of not less than nor more than 60 days suspended for 12 months and placed on unsupervised probation on condition he pay fine of $100 and costs, obtain substance abuse assessment, surrender driver’s license and perform 24 hours community service.

Brittany Renea Frizzell, 32, Sylva, possess marijuana paraphernalia, placed on unsupervised probation for six months, ordered to pay fine of $50 and costs, perform 24 hours community service and complete Drug Education School.

Joshua Robert Pressley, 29, Canton, two counts larceny by trick, sentence of 120 days suspended for 24 months and placed on unsupervised probation on condition he pay fine of $50 and costs, make restitution and have no contact with anyone at and not be on premises of WNC Paving, given credit for 63 days served.

Michael James Bailey, 32, Duckback Trail, Whittier, child abuse, sentence of 75 days suspended for 18 months and placed on supervised probation on condition he pay fine of $100 and costs, report for initial evaluation by TASC, comply with DSS recommendations and not engage in corporal punishment with any of his children, defendant appealed.

Pascual Cuatlayo Tochihuitl, 45, Laurel Knob Road, Cashiers, waived preliminary and was bound over to Superior Court on charges of possess with intent to manufacture/sell/deliver methamphetamine and marijuana, posses drug paraphernalia, possess methamphetamine, possess Schedule II substance, possess marijuana paraphernalia, maintain/ vehicle/dwelling/place for controlled substance and resist public officer and was bound over to Superior Court.

Feb. 4

Three defendants had cases heard Feb. 4 during a session mainly for juvenile cases presided over by Judge Monica Leslie:

Jessica Lynn Burnett, 38, University Heights Road, Cullowhee, two counts school attendance law violation, sentence of 30 days suspended for 12 months and placed on supervised probation on condition she pay fine of $25 and costs.

Sasha Leigh Watson, 36, Cheerful Cove, Cullowhee, school attendance law violation, prayer for judgment continued from term to term for one year on condition she pay fine of $25 and costs.

Tracy Allen Watson, 38, Cheerful Cove, Cullowhee, school attendance law violation, prayer for judgment continued from term to term for one year.
