Two sessions of Jackson County District Court were held last week at the Justice Center with Judge Donna Forga presiding.

A session mainly for traffic cases was held Sept. 27, with a session for other cases Sept. 28.

Results of the sessions are listed below, with information obtained from records on file with the Jackson County Clerk of Court office. Defendants pleaded guilty unless indicated otherwise. In addition to dismissals and infractions, dispositions included:

 

Sept. 27

Jay Dean Mahon, 63, Choctaw, Okla., driving while impaired – level five, sentence of not less than nor more than 60 days suspended for 12 months and placed on unsupervised probation on condition he pay fine of $100 and costs, obtain substance abuse assessment, surrender driver’s license and perform 24 hours community service.

Colton Daniel Painter, 30, Nicholson Cove Road, Cullowhee, driving while impaired – level five, sentence of not less than nor more than 60 days suspended for 12 months and placed on unsupervised probation on condition he pay fine of $100 and costs, obtain substance abuse assessment, surrender driver’s license and perform 24 hours community service.

Hipolito A. Martinez Cordero, 43, Leicester, carrying concealed gun, sentence of 30 days, suspended for 12 months and placed on unsupervised probation on condition he pay fine of $50 and costs.

Shannon Denise Garcia, 34, Franklin, larceny, sentence of 45 days suspended for 24 months and placed on unsupervised probation on condition she pay fine of $50 and costs, make restitution and not be on premises of Hot Spot.

Jeffery Lee Declue, 68, Whittier, drunk and disruptive, sentence of one day, given credit for one day served.

 

Sept. 28

Scotty Lee Nelson, 38, Union Hill Road, Whittier, interfere with electronic monitoring device, sentence of 120 days suspended for 24 months and placed on supervised probation on condition he make restitution of $2,314.

John Preston Rickman, 34, Likawanata Drive, Sylva, possess Schedule II substance and driving while license revoked, sentence of 120 days suspended for 24 months and placed on supervised probation on condition he pay fine of $25 and costs and report for initial evaluation by TASC, given credit for 29 days served.

Jordan Daniel Nail, 35, Winston-Salem, disorderly conduct, prayer for judgment continued from term to term on condition he pay costs.

Adam Michael Self, 33, Morristown, Tenn., drunk and disruptive, prayer for judgment continued from term to term on condition he pay costs.

Lehua Joan Walkingstick, 42, Bedrock Road, Whittier, larceny, sentence of 60 days suspended for 36 months and placed on unsupervised probation on condition she pay fine of $50 and costs and not be on premises of Walmart.

Joshua Orlikowski, 38, Archer Road, Jonesborough, Tenn., communicating threats, sentence of 120 days suspended for 24 months and placed on unsupervised probation on condition he pay costs and have no contact with victim, given credit for 34 days served.

Jami Jeanette Bailey, 29, Rutherfordton, resisting public officer, sentence of 60 days suspended for 12 months and placed on supervised probation on condition she pay fine of $50 and costs and not be on premises of Harrah’s Cherokee Casino, given credit for 12 days served.

Cortney Leigh Hicks, 29, Hicks Hollow Road, Cherokee, larceny, sentence of 45 days suspended for 24 months and placed on unsupervised probation on condition she pay fine of $25 and costs and not be on premises of Walmart, given credit for 34 days served.

Simon Hans Joest, 27, Bourbon Street, Whittier, assault inflicting serious injury, sentence of 60 days suspended for 24 months and placed on unsupervised probation on condition he pay fine of $50 and costs, perform 24 hours community service and have no contact with victim.

Brandi Nicole Moore, 27, Floral Drive, Sylva, admitted to two counts of probation violation, on each count probation revoked and sentences of 120 days and 90 days activated, given credit for 48 days and 41 days served, sentences to run concurrently.

Allen Dewayne Rathbone, 40, Waynesville, admitted to three counts of probation violation, on each count probation revoked and sentences of 150 days, 120 days and 116 days activated, given credit for 150 days, 120 days and 116 days served.

Antonio Lamont Smith, 49, Hornbuckle Creek Road, Cherokee, admitted to a probation violation, probation terminated unsuccessfully.

Carolyn Rachel Reed, 23, Webster Estates Mobile Home Park, Sylva, stalking, sentence of 35 days, given credit for 35 days served, ordered to have no contact with victim.

Mike Alexander Green, 31, Peppermill Lane, Sylva, larceny and injury to personal property, sentence of 25 days; also admitted to a probation violation, probation revoked and sentence of 90 days activated, given credit for 33 days served, sentences to run concurrently.

Anthony Brett Coggins, 39, Jimmy Morris Road, Sylva, possess drug paraphernalia, placed on unsupervised probation for 12 months, ordered to pay fine of $50 and costs, perform 24 hours community service and complete drug education school.

William Robert Daves, 59, Cope Creek Road, Sylva, was found guilty of assault on a female and sexual battery, sentencing continued to Nov. 23.

Chaz James Brian Hodgins, 30, Long Branch Church Road, Sylva, possess drug paraphernalia, larceny and possess Schedule II substance, sentence of 45 days suspended for 12 months and placed on supervised probation on condition he pay costs, report for initial evaluation by TASC and have no contact with and not be on premises of victim.

Travis Collins, 43, Franklin, waived probable cause hearing and was bound over to Superior Court on a charge of intentional child abuse with serious physical injury.

 

Special session

One case was heard at a special session Sept. 27 presided over by Judge Monica Leslie:

Michael James Bailey, 34, Duckback Trail, Whittier, assault on a female, sentence of 60 days suspended for 12 months and placed on unsupervised probation on condition he pay costs, perform 12 hours community service and have no contact with victim, defendant appealed.
