The Webster Memorial Cemetery Board of Trustees wishes to make known specific information in reference to the maintenance and business divisions of this historic landmark. The Town of Sylva Board of Commissioners shall conduct two public hearings on September 18, 2008 at 9:15 a. m. in Municipal Hall, 83 Allen Street, Sylva NC. BEGINNING on a #4 rebar set, the northeast comer of Lot 17A, a 0.82 acre tract, said rebar being located N 72-47-35 E 33.38 feet from a #4 rebar set in the line of OHaire, now or former (DR 1086-101 and 1086-95), at the northwest comer of Lot 17A which is comer of Tract Two of deed conveyed from Big Ridge Conservancy Trust to Spring Mountain Estates, Inc.; thence from the point of the beginning, N 72-46-15 E 179.83 feet to a #4 rebar, the northwest comer of lot 18A, a 0.71 acre tract as shown on the survey hereinabove referenced; thence with the western boundary line of said Lot 18A, S 07-46-40 E 313.26 feet to a rebar set in the fifty (50) foot right of way for existing gravel access road; thence S 07-46-40 E 4.37 feet to a point in the centerline of said road and right of way; thence leaving the line of Lot #18A and with the centerline of said road and right of way, S S4-01-40 W 50.12 feet to a point in the centerline, the southeast comer of Lot 17A; thence leaving the road and running with the line of Lot 17A, N 31-44-00 W 6.08 feet to a #4 rebar set, and N 31-44-00 W 307.45 feet to the point and place of the beginning.
Being the same lands described by deed dated May 20, 2005 from Spring Mountain Estates, Inc., a North Carolina corporation, to Yolanda Serrano, a married woman, recorded in Book 1503, Page 205, Jackson County Public Registry.
There is farther conveyed to the Trustee, his successors and/or assigns, the joint right to the use of the thirty (30) foot road right of way easement leading from NCSR #1129, and thence continuing at a width of fifty (50) feet to, and thence along, the southern boundaries of the lands hereinabove described and conveyed. Said rights of way to be used jointly for the purposes of ingress and egress and for the purposes of inspecting, servicing and maintaining said roads and rights of way.
This instrument is made and given SUBJECT TO the exception and reservation unto Springs Mountain Estates, Inc., its successors and/or assigns, the joint right to the use of that portion of the fifty (50) foot road right of way easement lying within the southern boundaries of the lands hereinabove described and conveyed, as set forth in deed recorded in Book 1503, Page 205, Jackson County Public Registry. Said right of way to be used jointly for the purposes of ingress and egress and for the purposes of inspecting, servicing and maintaining said roads and rights of way.
