The sale will be made subject to all prior liens, unpaid taxes, restrictions, and easements of record, if any.

All bidders bid for the property AS IS on the date of sale and the highest bidder assumes the risk of loss or deterioration after the sale. Absolutely no warranties are made as to the condition, value, or title to the property. While the Substitute Trustee believes the title to be good, all bidders are advised that they should obtain independent counsel to examine record title as the property is sold subject to prior record interests. The Noteholders have reserved the right to withdraw the sale up to and until the Deed is delivered by the Substitute Trustee.

Pursuant to the terms of N.C.G.S. §45-21.10(b), the successful bidder may be requested to deposit to the Substitute Trustee immediately upon conclusion of sale, a cash deposit of Seven Hundred Fifty And No/100 ($750.00) Dollars or five percent (5%) of the total bid, whichever is greater. Any successful bidder shall be required to tender the full balance of the purchase price so bid in cash or certified check at the time the Substitute Trustee tenders to him a deed for the property and, should he fail to pay the full balance of the purchase price so bid at that time, he shall remain liable on his bid as provided for in N.C.G.S. §45-21.20(d)and(e).

The Town of Sylva Zoning Board of Adjustments shall conduct a public hearing on February 7, 2008, at 7:00 p.m. in Municipal Hall, 83 Allen Street, Sylva NC. Mr. Don Arrington and Mr. Randy Kinsland have formed a new corporation, MetalWood Recycling Inc. They are requesting conditional use of a parcel located off Skyland Drive in a B-2 Business District, for a recyclable material collection and transfer station. This use is permitted in the B-2 Business District with a Conditional Use Permit approved by the Zoning Board of Adjustments.

MEETING NOTICE

The Town of Dillsboro's Monteith House Steering Committee will now follow a regular schedule of meetings.

Beginning in March, the Committee will meet at 10 a.m. the second Thursday of each month unless otherwise posted at the Town Hall in Dillsboro. All meetings are open to the public; this committee is in charge of planning and executing the restoration of the Monteith House for use as the Appalachian Women's Museum.

 NOTICE OF SALE

NOTICE IS HEREBY GIVEN that by virtue of the power of sale contained in the Declaration of Individual and / or Interval Ownership for Foxhunt Townhouse Association, Inc., and recorded in the Office of the Register of Deeds for Jackson County, North Carolina, in Book 526, Page 388, and pursuant to N.C. Gen. Stat. §§47F-3-116 and because of default in the payment of association assessments, the undersigned Trustee, Dorinda Watford shall on February 8, 2008 at 10:00 a.m., at the door of the Jackson County Courthouse, offer for sale at public auction to the highest bidder for cash, the following described property:

LEGAL DESCRIPTION: Lot Week Number 49, Townhouse Number 1501, Building Number 10, Foxhunt Townhouses as shown on a plat recorded in Plat Cabinet 4, Slide 810, Jackson County Registry. As more specifically described in that deed recorded in Deed Book 1505, Page 233, Jackson County Registry, North Carolina. 

Being the same property described in a deed made and entered into on May 17, 2005 by and between Vivian T. Hodges, grantor(s) and Jerry Leroy Edwards, grantee(s) and recorded in Deed Book 1505, Page 233 Jackson County Registry.

The terms of the sale are that the real property hereinabove described will be sold for cash to the highest bidder and that the undersigned may require the successful bidder at the sale to immediately deposit cash in the amount of ten (10%) percent of the high bid up to $1,000.00, plus five (5%) percent of any excess of $1,000.00. The real property hereinabove described will be sold subject to all prior liens, unpaid taxes, restrictions and easements of record, tax liens and assessments.

The sale will be held open for ten days for upset bids as by law required.

The record titleholder to said property, ten (10) days prior to posting of this Notice, is Jerry Leroy Edwards.
