Pursuant to a court order entered in the above captioned matter on the 2nd day of March, 2007, I will on the 30th day of August, 2007 at 11:00 o’clock a.m., at the door of the Jackson County Justice and Administration Building, 401 Grindstaff Cove Road, Sylva, North Carolina, offer for sale at public auction to the highest bidder for certified funds and/or cash all right, title and interest to a 2001 Western Star Dump Truck, being more particularly described as follows:
A red 2001 Western Star Quad Axle Dump Truck VIN #2WLPCDXJ41K970085, Model 4964FX, with a GVWR of 58,060 pounds; S60 Detroit Diesel 12.7L motor with a RTO16908ll transmission; FL941 front axle; RT44145P rear axle; all this information is obtained from a factory installed Western Star placard on the door jam. The vehicle model description is 6X4 Constellation Series 123" BBC Steel (FG Hood & Feeders) Long Conventional C, w/Air Brakes and power steering; stainless steel dual air cleaners, aluminum disk wheels, cab mounted dual vertical chrome exhaust, double frame rails, tag axle, locking differential for tandem, upgraded day cab interior, sideboards, 10-12 cubic yard R&S dump body and has 209,939.2 actual miles pursuant to computer readings by Carolina Truck and Body.
The truck will be available for public inspection at the Jackson County Sheriff’s Department, 399 Grindstaff Cove Road, Sylva, North Carolina in the parking lot in front of the entrance to the Sheriff’s Department on Tuesday, August 28, 2007 from 7:00 a.m. until 10:00 a.m. and Wednesday, August 29, 2007 from 3:00 p.m. to 5:00 p.m. The truck can also be seen on the Jackson County Sheriff’s web site at www.sheriff.jacksonnc.org.
The vehicle being offered pursuant to this notice of sale is being offered for sale, transfer and conveyance in an "AS IS CONDITION”. The Sheriff, nor the officers, employees, agents or authorized representatives of the Sheriff make any representation or warranty relating to the property being offered for sale, and any and all responsibilities or liabilities arising out of or in any way relating to any such condition expressly are disclaimed.
