One ‘cake vandal’ pleads to charge of conspiracy
By Carey Phillips
One person charged with vandalizing the Sylva Police Station pleaded guilty to conspiracy during the Jan. 23 session of Jackson County District Court.
A charge of attempted breaking and entering against Shawn Bubacz, 34, of Tilley Creek Road, Cullowhee, was dismissed.
Judge Steve Bryant sentenced Bubacz to 60 days suspended for 24 months. He was ordered to pay costs and make restitution of $514 along with co-defendant Zachary Hughes. Bubacz was given credit for 15 days served and ordered to not be on the premises of the police station unless he is in need of emergency assistance.
Hughes, 34, of Old Cullowhee Road, Cullowhee, did not appear for a Feb. 6 court date and an order was issued for his arrest. His next court date is April 3.
In addition to failure to appear, Hughes is charged with three counts of larceny, two counts possession of stolen goods and injury to real property and one count each of attempted breaking and entering, injury to personal property and conspiracy.
The damage to the police station was discovered just after 3 a.m. Saturday, Jan. 6. Part of the vandalism included cake that had been thrown on the building.
That evidence, along with cake found nearby and on Main Street, helped lead investigators to Bubacz and Hughes, who were found at a house in the area of Allen and Hampton streets near the police station.
