NOTICE OF FORECLOSURE RE-SALE UNDER DEED OF TRUST

Under and by virtue of an order of the Clerk of Superior Court of Jackson County, North Carolina entered in the above-entitled action on May 4, 2006 authorizing the undersigned to proceed with the foreclosure of the above-referenced Deed of Trust was recorded in Deed Book 1494, Pages 53-56 and re-recorded in Book 1495, Pages 3-6 in the office of the Register of Deeds of Jackson County, North Carolina, whereby the undersigned was substituted as Trustee under the provisions of said Deed of Trust (See Substitution of Trustee instrument recorded in Book 1562, Pages 357-358, Jackson County Public Registry) and under and by virtue of the power of sale contained in the above-referenced Deed of Trust, the undersigned Substitute Trustee will offer for resale at public auction to the highest bidder for cash at ten o'clock (10:00) AM., on the 11th day of July, 2006, at the Jackson County Justice and Administration Center, 401 Grindstaff Cove Road, in Sylva, Jackson County, North Carolina, the property described in the Deed of Trust recorded in Book 1494, Pages 53-56 and re-recorded in Book 1495, Pages 3-6, Jackson County Registry which description is incorporated herein by express reference as if fully set out herein.

This is a resale of the above-described property, a previous sale having been held on the 1st day of June, 2006 under and by virtue of an order of the Superior Court of Jackson County, North Carolina, however, publication of the Notice of Hearing as required by law was not had, therefore Order of Resale was entered on the 20th day of June, 2006. 

The above-described property will be sold subject to all unpaid county and city ad valorem taxes, special assessments, prior liens, and encumbrances, if any.

The record owner of the property as reflected on the records of the Register of Deeds' office not more than ten (10) days prior to posting of this notice is Richard Allen Guenther. 

The Substitute Trustee will require a deposit equal to five percent of the bid or $750.00, whichever is greater, from the highest bidder at the time of the sale as evidence of good faith. 

If the highest bidder fails to make the required deposit the person holding the sale may at the same time and place immediately reoffer the property for sale. Any successful bidder shall be required to tender the full balance purchase price so bid in cash or certified check at the time the Commissioner tenders to him/her a deed for the property or attempts to tender such deed. 

The sale will be reported to the court and will remain open for advance or upset bids for a period of ten (10) days as required by law.

Under and by virtue of a Power of Sale contained in that certain Deed of Trust executed by Alva L. Wallis III, A MARRIED PERSON and Susan A. Wallis, A MARRIED PERSON to Stuart Clarke at Thorpe & Clark, Trustee(s), which was dated March 18, 2004 and recorded on March 19, 2004 in Book 1408 at Page 619, Jackson County Registry, North Carolina.

NOTICE OF SUBSTITUTE TRUSTEE'S FORECLOSURE SALE OF REAL PROPERTY

UNDER AND BY VIRTUE of the power and authority contained in that certain Deed of Trust executed and delivered by Jamie E. Lewis and Tina M. The terms of the sale are that the real property hereinbefore described will be sold for cash to the highest bidder. The Substitute Trustee reserves the right to require a cash deposit or a certified check not to exceed the greater of five percent (5%) of the amount of the bid or Seven Hundred Fifty Dollars ($750.00). In the event that the Owner and Holder is exempt from paying the same, the successful bidder may also be required to pay revenue stamps on the Trustee's Deed, any Land Transfer Tax, and the tax required by N.C.G.S. §7A-308 (a) (1).

The real property hereinabove described is being offered for sale "AS IS, WHERE IS" and will be sold subject to all superior liens, unpaid taxes, and special assessments. Other conditions will be announced at the sale. The sale will be held open for ten (10) days for upset bids as by law required.

If the Trustee is unable to convey title to this property for any reason, the sole remedy of the purchaser is the return of the deposit. Reasons of such inability to convey include, but are not limited to, the filing of a bankruptcy petition prior to the sale and reinstatement of the loan without the knowledge of the Trustee(s). If the validity of the sale is challenged by any party, the Trustee(s), in their sole discretion, if they believe the challenge to have merit, may declare the sale to be void and return the deposit.
