Charges dropped against one suspect in April arrest; others due in court June 20

One of four men arrested during an April 14 traffic stop in Cullowhee on drug-related charges has been cleared, and the other three are scheduled to appear in court next week.
All charges against DeMakus Staton, 21, of Laurel Oaks Apartments in Cullowhee have been dropped, according to documents on file in the Jackson County Clerk of Court’s office.
The other three arrested – Joshua David Byrd, 20, a Western Carolina University student from Hickory; Dennis Walter McQuaig Jr., 27, of Cope Creek Road, Sylva; and Timothy Dale Holder, 34, of Cherokee – are due in court on Tuesday, June 20, according to the Clerk’s Office.
The four were apprehended April 14 with significant quantities of controlled substances after Deputy Kenneth Woodring of the Jackson County Sheriff’s Office stopped a silver Oldsmobile on Slim Dillard Road for a minor traffic violation.
Woodring became suspicious after he noticed the men in the car seemed nervous, said Capt. Steve Lillard. Woodring asked for and received permission to search the vehicle, Lillard said.
During the search, Woodring, who was assisted by Deputy Charles Crisp, located 6.5 grams of marijuana, 2 grams of powder cocaine, 10 grams of crack cocaine and .2 grams of methamphetamine, Lillard said.
Arrested at the scene were Byrd, McQuaig, Staton and Holder, who was driving the car. Three of the four initially faced charges of possession with intent to sell/deliver meth, crack cocaine and powder cocaine; Holder was charged with possession of marijuana, possession of crack cocaine and possession of meth.
Charges against Staton were dismissed May 10 with the notation that “no drugs were found on Mr. Staton.”
