Re: FINANACING AGREEMENT

The Jackson County Board of Commissioners will be available for public comment on Monday, November 7, 2005, 5:45 p.m., Justice & Administration Building, 401 Grindstaff Cove Road, Room A201, Sylva, North Carolina

The purpose of the Public Hearing is to receive public input concerning a financing agreement for borrowing $9,507,386.00 for the Cashiers Library Expansion and Smoky Mountain High School Improvements, Phase III.

Citizens are invited to make written or oral comments.

Wayehutta Trail Addition

Pursuant to 36 CFR 215.5, District Ranger Erin M. Bronk requests comments on the Wayehutta Trail Addition Project located in Jackson County. Specifically, this project would result in the addition of approximately 1 mile of new trail to be added to the existing Wayehutta ATV Trail System. The new trail section would utilize an existing roadbed and replace a poorly placed culvert with a new trail bridge.

This project was originally proposed in a legal notice published on March 18, 2004 in both the Highlander and the Sylva Herald and Ruralite. A recent Federal Court decision in Earth Island Institute v. Ruthenbeck invalidated the provisions of 36 CFR Part 215 that excluded categorical exclusions from notice, comment and appeal procedures. The District Court further clarified that its order is to be applied prospectively after July 7, 2005 nationwide. Since this proposal is subject to the Court order, formal notice and comment period is being established.

I recognize that many individuals have already provided comments on this proposal; however, due to the Earth Island ruling, substantive comments (36 CFR 215.2) must be resubmitted to establish appeal eligibility. The opportunity to comment on this project ends 30 days following the date of publication. In addition, to have appeal eligibility, each individual or representative from each organization submitting substantive comments must either sign the comments or verify identity upon request.

Comments should be sent to: Highlands Ranger District, 2010 Flat Mountain Road, Highlands, NC 28741, fax (828) 526-5593. Oral or hand-delivered comments must be submitted Monday through Friday between the hours of 8:00 a.m. and 4:30 p.m. Comments may be mailed electronically in a common digital format to our office at HYPERLINK "mailto:comments-southern-north-carolina-nantahala-highlands@fs.fed.us" comments-southern-north-carolina-nantahala-highlands@fs.fed.us. In accordance with regulations, all written comments received, including those submitted electronically, will be placed in the project file and will become a matter of public record.
