UNDER AND BY VIRTUE OF the power and authority contained in that certain Deed of Trust executed and delivered by Lanny R. Should the property be purchased by a third party, that person must pay the tax of forty-five (45) cents per One Hundred Dollars ($100.00) required by NCGS 7A-308 (a)(1). This sale is also subject to any applicable county and/or state land transfer and/or revenue tax, and the successful third party bidder shall be required to make payment for such tax.
The property to be offered pursuant to this notice of sale is being offered for sale, transfer and conveyance "AS IS, WHERE IS". Neither the Trustee nor the holder of the note secured by the Deed of Trust/Security Instrument, or both, being foreclosed, nor the officers, directors, attorneys, employees, agents or authorized representative of either Trustee of the holder of the note make any representation or warranty relating to the title or any physical, environmental, health or safety conditions existing in, on, at, or relating to the property being offered for sale, and any and all responsibilities or liabilities arising out of or in any way relating to any such condition expressly are disclaimed.

The Jackson County Board of Commissioners, the Town of Sylva, the Town of Webster, the Town of Dillsboro, and Village of Forest Hills will hold a joint governmental meeting on Tuesday, October 5, 2004, 6:00 p.m., Justice and Administration Building, 401 Grindstaff Cove Road, Room A201, Sylva, North Carolina.
This is a joint meeting to discuss matters, which anyone of the units feels to be of interest, potential benefit or potential harm to any or all of the other units.

NOTICE OF PUBLIC HEARING
The Jackson County Board of Commissioners will be available for public comment on Tuesday, October 12, 2004, 6:00 p.m., Justice & Administration Building, Board Room 201A, 399 Grindstaff Cove Road, Sylva, North Carolina.
The purpose of this meeting is to solicit public input for the project including the description of the proposed project, project location, activities to be carried out, total cost of activities and financial design. Jackson County's proposal is for $700,000.00 to be utilized for water and sewer, storm drainage, home rehabilitation or relocation in a concentrated needs area. It is expected that six to eight low-income homeowner will be served through this program. The public is encouraged to make comments and recommendations concerning the proposed concentrated needs plan. If anyone has additional information, please contact Mr. Kenneth L. REAL PROPERTY
Under and by virtue of the power and authority contained in that certain Deed of Trust executed and delivered by Gregory D. Smith and Angela D.
